Terms and Conditions

These terms and conditions apply to purchases in the Helena Patelisová online store (www.helenapatelisova.com/obchod). The terms and conditions define and clarify the rights and obligations of the seller and the buyer (customer).

The terms and conditions in their current version form the content of the purchase contract concluded between the seller and the buyer.

By sending the order, the buyer confirms that he agrees with the Terms and Conditions and that they will apply to all relations between the seller and the buyer when concluding a purchase contract and any claim for goods.

Order of goods

All orders made on www.helenapatelisova.com are binding for both parties. By sending the order, the buyer confirms that he has familiarized himself with these General Terms and Conditions. The seller confirms the acceptance of the order by sending a confirmation e-mail. The seller reserves the right not to accept an order from a buyer who has not properly received or paid for the goods in the past. The buyer can cancel the order via e-mail within 24 hours of sending the order. The buyer is responsible for damages incurred by the seller due to improper use of the online store.

 

The seller reserves the right to cancel the order in the event that:

 

  • the required contact information is not properly filled in by the buyer.

 

  • the requested goods will not be available in stock at the supplier for a long time. The seller will inform the buyer about this fact without undue delay.

Goods price

The price of the goods is always indicated for individual items. All product prices are listed in value including tax. To the price of the goods is added the price for transport according to the chosen delivery method.

  • payment by credit card and delivery by Zásilkovna

  • payment by credit card and personal collection of the goods in the studio after receipt of payment at the address Bořivojova 114, Prague 3, or after telephone or e-mail communication at another location specified by the buyer and located in the center of Prague.

Delivery time

The seller undertakes to send the goods that are in stock within 3 working days from the receipt of payment for the goods on the account.

The delivery period is around 14 working days from the receipt of the binding order, or from receipt of payment for the goods on the account. The buyer undertakes to pay the full amount of the purchase price of the goods, including postage. The buyer acquires ownership rights to the goods until the date of full payment of the price in favor of the seller. The seller is not responsible for delayed delivery of goods caused by the post office, courier or Another delivery service, or damage to goods caused by the post office, the Post Office or delivery service. The seller is not responsible for the impossibility of delivering the goods due to force majeure or in the event that the ordered goods are not in stock within the requested period. The order can be canceled within 24 hours of receiving the information e-mail.

Withdrawal from the contract, return of goods

In accordance with applicable laws, the buyer is entitled to return the goods without giving a reason to the seller within 14 days of receiving them. It is necessary to withdraw from the contract in a demonstrable way (in writing, by e-mail) stating the order number and date of purchase.

Later withdrawal from the contract is no longer possible. Subsequently, the buyer sends the goods back to the seller, or, after prior agreement, delivers them personally to the address Bořivojova 114, Prague 3, no later than 21 days from the delivery of the goods to the buyer. In this case, the buyer is obliged to return the unused and complete goods in the original undamaged packaging together with the proof of purchase. The costs associated with returning the goods are paid by the buyer. We recommend sending the goods as an insured shipment. When returning goods, it is not possible to accept the return of goods by cash on delivery or if the goods are damaged on the way. If all the above conditions are met, the seller undertakes to return the paid purchase price to the buyer by bank transfer within 14 working days of receiving the goods.

All our products are subject to availability. In the event that we are unable to deliver the goods that the buyer ordered or would like to exchange, we will inform him as soon as possible by e-mail.

Final Provisions

All changes to these general terms and conditions will be made exclusively in writing and will be published on the seller's website (www.helenapatelisova.com) no later than the day they come into force. These general terms and conditions are valid from 12/01/2022.

Complaints Procedure

The right to claim

  • If there is damage to the purchased goods, the buyer has the right to claim the goods. For a correct assessment, it is necessary that the claimed goods are returned clean and complete. When using the goods, the buyer is obliged to observe, in addition to the generally known rules, also the conditions set for the use and care of the goods in accordance with their natural lifespan. Complaints cannot be applied to damage caused by a third party - e.g. the seller is not responsible for products being broken by the carrier, etc.​

Place and method of claiming​

  •  Complaints can be made in writing, by e-mail (info@helenapatelisova.com) or by post to the address: Ateliér B114, Helena patelisová, Bořivojova 114,  Prague 3. Claimed goods can be delivered in person by prior agreement or via a carrier. Please send us the claimed goods properly packed to prevent damage during transport. The complaint must include a written description of the damage that is the subject of the complaint and proof of purchase of the goods or postal delivery. The costs associated with sending the claimed goods to us are borne by the buyer.

  • After receiving the complaint, we will subsequently send the buyer an e-mail confirming delivery. If the buyer complains about the lack of goods, the seller will properly check the complaint.

  • In the case of a positive settlement of the complaint, the exchanged goods are sent back to the buyer at our expense. We ask the buyer to note that each piece is an original handmade work of art, therefore the exchanged goods may differ in subtle nuances or may no longer be available at all. The maximum time for processing a claim is set by law at 30 days, but since each piece is an original, we ask for your understanding if there is a delay during the claim, of which we will of course inform you immediately. If it is not possible to repair or replace the goods, we will send you the amount for the goods back to your account within 14 days.

The seller is not responsible for defects

  •  If the buyer caused the damage himself or if the buyer knew about the lack of goods before receiving the goods and for which a discount was given from the price of the goods. Defects that arose during the warranty period as a result of wear and tear of the goods due to incorrect or excessive use, if the goods were mechanically damaged or destroyed by improper handling or were damaged during transport.

Deadlines for making a claim

  • The seller is responsible for the defects of the goods for a period of 24 months from the time the buyer took over the item.

  • If the complaint is settled by repair, the warranty period is extended by the period from the application of the complaint to the day on which the consumer is obliged to take over the goods after the repair, even if he has not done so. If the claim is settled by exchanging the goods for new goods, the new warranty period starts from the day the goods were handed over, or sent to the buyer. If the claim for defective goods is not made within the warranty period, the right to liability for defects expires. The buyer will be informed in person, by phone, or by e-mail after the complaint has been processed.

Protection of your personal data

  • We value our clients and we try to adapt our communication with you to this fact. We understand that online shopping requires a lot of trust, and that's why we want to respect your privacy. We will not share any data you send with any third party and we promise that this website (www.helenapatelisova.com) is the sole owner of it. The exception is external carriers, to whom personal data of customers is transferred to the minimum extent necessary for the delivery of goods. We will also use this information to contact you if we have difficulties processing your order.

  • By purchasing on this website, you acknowledge and agree that for the processing of the order, ensuring removal, delivery of goods and possible solution of rights from defective performance (complaints), www.helenapatelisova.com will process and store in accordance with the regulation of the European Parliament and the Council (EU) 2016/679, general regulation on the protection of personal data (hereinafter referred to as GDPR), your personal data in the following scope: name, surname, address, e-mail and telephone number.

  • The legal basis for the processing of personal data is in accordance with Article 6 paragraph 1 letter b) GDPR.

  • Unless you ask us to do so, we may contact you by email in the future to inform you about special offers, new products, ceramic courses, workshops and changes to this privacy policy. Our Privacy Policy may change from time to time and any updates will be posted on this page.​

Custom production

In other words, goods made to measure according to the buyer's requirements

  • Helena Patelisová offers the production of ceramic products according to the specific requirements of the buyer. This method of custom production has a specific regime, especially regarding payments (advance payment is required in this case), delivery date (this is agreed individually and is confirmed by e-mail).

Withdrawal from the contract

  • With regard to withdrawal from the contract for custom production, in accordance with § 1837 of the Civil Code, the buyer cannot withdraw from the contract, the subject of which is the supply and modification of goods manufactured according to the wishes of the buyer or for his person.

The Seller may change the products and services described on its website at any time. We have the right to update or supplement these conditions if necessary.
